USER SUBMISSIONS
You may submit comments, testimonials, stories or other content to us via email links on the Site. You agree that any messages, communications, content or materials you submit to us are non-confidential for all purposes. Do not provide information you do not want shared with other users of the Site. We will not publish your identifying personal information (real name, email or phone number), however we my use your first name, last initial, and city to identify a story. We may add a picture (using a model or representative) for any stories submitted, and you agree that we may edit or change any content submitted. For any submissions you make, you automatically grant, or warrant that the owner of such communication, content or materials has expressly granted FitterLife.com a royalty-free, perpetual, irrevocable, world-wide nonexclusive and fully sub-licensable right and license to use, edit, distribute, reproduce, modify, create derivative works from, publish and display in any media and medium or form and format currently know or developed in the future.
INDEMNITY
You agree to defend, indemnify, and hold FitterLife.com, Genesis Interact, LLC its officers, directors, employees, agents, licensors, and suppliers, harmless from and against any claims, actions or demands, liabilities and settlements including without limitation, reasonable legal and accounting fees, resulting from, or alleged to result from, your violation of these Terms and Conditions.
MISCELLANEOUS
This Agreement shall be governed by and construed in accordance with the laws of the State of Oklahoma, without regarding provisions relating to conflicts of law. You agree that any legal action or proceeding for any purpose concerning this Agreement or the parties' obligations under this Agreement shall be brought exclusively in a court of competent jurisdiction in Tulsa County, Oklahoma, United States, and by accessing the Site you consent to the personal jurisdiction of any state or federal court located in the State of Oklahoma. Any cause of action or claim you may have with respect to the Site and/or this Agreement must be commenced within one (1) year after the claim or cause of action arises. This Agreement constitutes the entire Agreement with respect to your access and use of the Site. Any failure by us to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. We may assign our rights and duties under this Agreement to any party at any time without notice to you.
